The highway concession system is a long-term contract where the Public Entity owner of the road entrusts a private company with the construction, maintenance, and/or management of a road in exchange for payment. In this model, the public institution that owns the road maintains public ownership of the infrastructure at all times, but delegates its operation temporarily (for periods of more than 20 years) to private companies to avoid having to bear the entire initial cost.

In Spain, this type of contract was used for the construction of new highways starting with the 1964 National Toll Highway Plan, but this system has not only been used for highways, as there are provinces like Toledo where provincial roads are also concessioned.

A fundamental aspect of this type of contract is the need to establish the minimum required service quality within the contract. This quality of service is based on measurable indicators that allow for the evaluation of the road’s condition, Road Safety and accident rates, traffic flow, user services, and sustainability.

Road quality controls are necessary both during operation and upon reversion (when the road is returned to its concession holder at the end of the contract).
